On December 21st, 2021, seven members of the U.S. House of Representatives wrote to U.S. Attorney General Merrick Garland asking if the U.S. Department of Justice can investigate and prosecute our former administrators for their involvement in another website, Sanctioned Suicide. This followed the New York Times article regarding that website earlier this month.

Several members of various incel communities were aware of the situation but decided against writing a post on the issue at the time while we decided on the stance we take on the issue. Now, here is our current stance:

1. We currently do not believe there is any genuine threat to incels.is' current operations, or to the safety of our former administrators. Having discussed the matter, our analysis is that this is entirely political theater with little or no legal substance. The closest comparison I can make to this situation is when Ted Cruz and other members of Congress wrote letters to the DOJ asking then-AG Barr to prosecute Netflix on child pornography charges. Yes, that happened. Lawmakers pull stunts like this because they can virtue-signal to white mom lobby groups that they did something whilst punting the issue and deflecting blame for any inaction to the DOJ.

2. We have reliable information that since the publication of the New York Times article, a few U.S.-based individuals who we know of are actively lobbying members of Congress to censor incels.is, amongst other communities. Additionally, we know that these individuals seek to sow disinformation in these communities out of spite. However, their financial backing is pretty much zero relative to their aims, so we will not elaborate as not to give the crazies any legitimacy or publicity.

3. We note that one or more advocacy groups have also submitted their own comments on the issue of Sanctioned Suicide to the DOJ. We strongly and unreservedly support the right to freedom of speech, and the right to petition the government, as guaranteed by the First Amendment to the United States Constitution. To that effect, we have decided to add our perspective to the conversation.

We have submitted the following correspondence to Attorney General Garland. Copies of this letter were also sent to the seven members of Congress, and two reporters at the New York Times. We encourage every incel to read this letter in its entirety.

Thank you.

Uhhhhh... on the one hand I don't want Sarge and Master to go jail or anything, and they likely won't.

On the other hand, I have long been adamantly opposed to the idea of Sanctioned Suicide, both the forum and the concept itself. So I'm pretty secure in my conscience in not signing this letter. Is that what we're doing? Signing this letter?

Whatever we're doing, Sarge and Master will likely not be convicted of anything.

I wouldn't worry about it too much, they're just asking for information, even if something does happen it'll probably happen in a few years from now.

The fact that these seven members of Congress purportedly want to change the law is already a tell-tale sign that current U.S. law simply does not hold either of them criminally liable.

This is just a reminder to everyone that the First Amendment frowns very heavily on laws that engage in content-based regulation of speech.

Well there are (probably) limits to freedom of speech as far as what you can post on the Internet. For instance, I... probably couldn't publish instructions on how to bomb a school.

@Rhaast the whole discussion is talking about the US law, still doesn't indicate that the uruguay guy can't be legally persecuted

We disagree.

We are confident that, for the next several years at least, Congress will not have the political will necessary to amend Section 230, protecting site operators of controversial communities from most forms of liability.

We have simply decided that instead of letting other advocacy groups (i.e. the authoritarian feminist crowd) suck all the oxygen out of the political conversation, we should use our own speech rights effectively and eloquently and respond to those who do not seem to understand the First Amendment.

But you didn't tell me how to make the bomb. How I, an ordinary citizen, might get my hands on inexpensive materials to make my own homemade bomb that would do enough damage to hurt people.

In 1996, Congress passed a law that criminalized the distribution of certain information relating to explosives. See 18 U.S.C. § 842 (p).

First Amendment concerns were raised during the drafting of the bill. Therefore, federal law criminalizes the publishing of bomb-making instructions only if the information was a) distributed with the intent to further a "federal crime of violence", or b) knowingly distributed to a person who intended to use the information to further a "federal crime of violence". In practice, that is a very high bar for the government to prove beyond a reasonable doubt, so convictions under this statute have been extremely rare.

I'm pretty sure that's because people aren't trying it. "Intent to further a federal crime of violence," all that means is "Did the person hope someone would actually make a bomb or were they trolling?" If "proof" is simply what the jury thinks, I'm thinking most juries will err on the side that if you're posting bomb making instructions online, you know someone's gonna use it, and that's why you posted it.

I dont think they have any firm evidence that Serge or Master actually persuade or encouraged someone to kill himself, people who are on the edge have more understanding to each other than some sos phone that say "dont" and lock you up in a madhouse.

I am against suicide, but I understand that they had the right to talk about it.
Encouraging it on the other hand seems wrong to me now.

I hope Serge and Master get some good male lawyers to guide them.
I don't think they will be criminally charged but they might get civil charges.

While I understand the legality of the issue in that it should be illegal of a media institution of the United States to doxx individuals who clearly aren't doing anything wrong, understand that currently, the United States along with much of the west is now lawless. Recall that with the mandate hundreds of thousands if not more have lost their jobs, incomes, and livelihoods because they refuse to take a vaccine, if they can get away with doing that they can get away with anything which is just one example of lawlessness here. The rule of law now is effectively dead. :feelsjuice:
