Durante el debate legislativo, el proponente del proyecto, el diputado Jairo Salazar, sostuvo que la iniciativa tiene un carácter principalmente disuasivo, más que punitivo, y busca prevenir este tipo de conductas mediante la existencia de una sanción penal.

También se dejó claro que la norma no pretende ir en contra de la mujer, sino sancionar una conducta específica que afecta a la familia, al menor y al sistema jurídico.

El texto aprobado subraya que el objetivo es armonizar derechos, protegiendo tanto el interés superior del menor como los principios de buena fe, seguridad jurídica y justicia material, evitando que el fraude quede impune.
