Much depends on which of those armchair anthropologists are correct about human nature. If humans are naturally evil, the State should enforce whatever laws it deems appropriate in order to keep said humans in line. Hobbes articulated this process in his famous book, Leviathan.
If humans are naturally good, the State is responsible for any wrongdoing in society, thus it should be reduced and eventually dismantled.
I lean towards the view that humans are not universally evil or good, but that some humans are predisposed to doing evil and some are predisposed to doing good. Some genes predict criminal behavior, for example. There are people with hyper-empathic brains that would never hurt a fly.
