Why doesn't this surprise me:feelsseriously:. For context, Gran is the latin name for the city of Esztergom in Hungary, and in early 12th century, two synods took place there to basically decide how the Church should operate in this still relatively freshly-Christianized country, and one of the canons they came up with, to deal with marital problems and disputes, is this:

1753660921853

From another source:

A woman of noble rank who had deserted her husband three times was to be put under penance, and was to be prohibited from marrying again; but if she was a woman from the people she must be sold without hope of regaining her freedom.
A noble who wrongly accused his wife of infidelity must pay an adequate fine. If he would not, or could not do so, his head must be shorn and he must be sold as a slave. If anyone abducted the bride of another without her consent, she must be returned to her betrothed; but the robber, if of noble rank, must give the canonical compensation, do penance, and lose all hope of marriage. If he could not pay the required sum, he must be sold into perpetual bondage.
If anyone abandoned his wife, and refusing to come to terms with her, permitted himself to be put into prison for debtors, he became a slave forever on the ground of his hatred for his wife. And should he be seen at any time enjoying liberty, he must again be sold.

So, to sum it up:

A noblewoman deserts her husband three times → Has to do penance and is forbidden from marrying again. Basically she just gets a divorce, has to act theatrically how sorry she is for a while, and can't marry again so no other guy has to deal with her, but can simply go on living her life.

A non-noble woman, so either a serf, a regular free woman, or other non-noble in a feudal society does the same → Permanent enslavement, with the ban on her being manumitted specifically mentioned.

A nobleman accuses his wife of infidelity, and presumably can't prove it → Either pays a fine, or is enslaved.

A nobleman kidnaps another man's bride without her consent → Either pays compensation and is barred from ever marrying himself, or is sold as a slave.

Any man, presumably both noble and not, abandons his wife, refuses to make up with her, and puts himself in prison to be away from her → Permanent enslavement, with the ban on him being manumitted specifically mentioned.

No matter how I look at it, there's one group in here that just blatantly has a better deal than all the others, and it's not even close:feelsjuice:. Non-nobles dare to not honor the "sanctity" of marriage, boom, permanent enslavement because the Church says so. Noblemen fuck around a bit, boom, here's a dose of enslavement so you'll learn the consequences of your actions before your rich relatives bail you out (unless the ban on abandoning your wife really did apply to both nobles and normal people, though even then noblemen would probably just be shielded from any permanent enslavement.) Noblewomen shit on the sanctity of marriage, go around fucking other guys than their husband and absolutely not care about the fact that they are supposed to be loyal? Eh, what can even be done, those are high-born women, you don't want to anger their fathers, brothers or sons, let's just allow them to do whatever they want, but if they don't want to be loyal, let's forbid them from ever marrying again, yeah, that'll show them:soy:.

:feelskek:

Also note the "without her consent" stipulation in cases of bride kidnapping, or how women had to leave their husbands three times to be punished, but no number is mentioned when it comes to men abandoning their wives, there the punishment should come right after the act:feelswhat::feelsUgh:.

Thank you very much, it was very interesting to read your research on the marriage laws of medieval Hungary.

Thanks for sharing this. It’s even more brutal when you consider that society was way more religious than now.
