In the video itself they recommended after they left that he should have contacted a lawyer as well because a day or so after they arrested him in the cover of darkness. They were going to arrest him anyway

What probably got him was the comment saying he was going to go ER, that could relatively reasonably interpreted as a threat. Everything else he said about killing women and non-whites or advocating violent revolution is unambiguously legally protected speech and it's idiotic they even brought it up during the questioning.

There is legal precedent from the Supreme Court roughly defining the limits of speech of this general sort; Criminal threats need to be credible, and in the case of inciting or advocating violence it needs to be "directed to inciting or producing imminent lawless action and is likely to incite or produce such action".
That's a high bar that makes the overwhelming majority of advocacy of violence legal in the overwhelming majority of circumstances. Not that the cunt glowie knows or cares.
