Someone in my immediate family has issues with the law and the public defender told them to just plead guilty and take the jail time. They got a lawyer and successfully got out of jail time.

Eh, I just get annoyed by the trope (hammered into normies by years of TV) that public defenders are dumber or worse at lawyering. Here's a more lengthy explanation.

Public defenders don't get to choose which cases they want to take, so naturally their outcomes are going to be worse. That and their clients are typically poorer, less educated, and have more extensive criminal histories compared to people who can afford to retain their own counsel.

Main reason why PDs generally lead to worse outcomes is that their offices are significantly underfunded and they have to juggle far too many cases at the same time, but this varies a lot by city and state and isn't much of an issue at the federal level. What you're describing (poor representation) occurs far more often at the state and local level, which does account for over 95% of all criminal prosecutions in the U.S.

The feds have bigger and more consistent budgets relative to their caseload, and federal law puts federal public defenders and federal prosecutors on the same government payscale. A Stanford Law Review poll of judges suggests that federal judges actually have a higher opinion of the quality of public defenders than they do of the quality of privately retained counsel.



So for this reason I don't actually think Genco is at a significant disadvantage. I think experience is far more important, and I doubt they're assigning a 26-year-old right out of law school with a hate crimes case. If Genco does manage to find someone with experience handling high-profile hate crimes, terrorism, espionage cases, et cetera, great -- but there aren't many, just because of how rare these cases are. But he wouldn't benefit much just by hiring a random criminal defense lawyer in the suburbs whose experience probably revolves around, say, DUIs or child porn.
