Consent is present if you say “you may sex with me while I’m sleeping.” Even if consent is not given in the very moment, consent is still applied if it’s given soon enough beforehand. Just as it’s not rape to commence with sex if consent was given at the beginning if consent is not explicitly stated every two minutes.
