At least under Jim Crow, the law was "separate but equal", you could seperate blacks and whites by gender, but you had to accomodate them both. For example, there were segregated water fountains and bathrooms, but you couldn't deny a bathroom or fountain to one particular race. People were segregated but at least under the law, equal.
