I'm sure most of you who have a passing interest in American constitutional law are aware that the 1970s featured a quite a number of death penalty cases. This is one of them.

Coker v. Georgia (1977) (link to the Library of Congress' full text PDF) ruled that the death penalty would constitute "grossly disproportionate" and "excessive" punishment, so would violate the Eighth Amendment's protection against cruel and unusual punishments.

In the plurality opinion, Justice Byron White wrote:
Although rape deserves serious punishment, the death penalty, which is unique in its severity and irrevocability, is an excessive penalty for the rapist who, as such and as opposed to the murderer, does not unjustifiably take human life.

However, the Supreme Court would not outlaw the use of the death penalty in cases of child rape until Kennedy v. Louisiana (2008). Kennedy opined that in civilian courts, only premeditated murder and treason were severe enough to warrant the possibility of a death sentence.

Coker is an opinion which I admire for three reasons. First off, I'm an opponent of the death penalty in general. Second, because it was unpopular, and would probably be even more unpopular now; cases like these reaffirm that independent judicial review is sine qua non to the preservation of liberal and democratic political values. Last but not least, Coker was a well-needed opinion in an era where racial bias played an extremely prevalent role in criminal sentencing (and the criminal justice system overall); even though only a relatively small number of rape cases led to a death sentence, the vast majority of rapists in Georgia who received the death penalty were black men convicted of raping white women. Cases involving white men and/or black victims tended to result in comparatively lenient sentences.

Social media now serves as the court of public opinion and the more outrage on there about a crime committed, the worse the legal punishment IRL for the person suspected of committing the crime.
 
They should introduce the death penalty for females that lie about getting raped.

I am for death penalty but using it for rape against an adult female is not justified imo.

It is based that their supreme court realized this, and even emphasized female" rape as if it is less worse than rape against a male(which it obviously is but that could never have been said today).

Remember when Aaron Persky was recalled by Californian voters for giving Brock Turner a six-month sentence, even though such a sentence was in line with Californian law and the recommendations of Turner's female probation officer?

Personally, I think the recall was a dangerous slap in the face to judicial independence.

I guess that's what happens when the rule of law is superseded by majority public opinion. Didn't know Turner's six month sentence was in line with California law and the recommendations of Turner's female probation officer, because the coverage of the incident didn't mention that. I guess it was buried in the finer legal details.

On the plus side, only several states actually allow the recall of a judge.

See, the most severe rape charges were dropped by prosecutors; Turner was found guilty of two counts of penetration and one count of assault with intent to rape. He was a 19-year-old with no criminal history, and his probation officer noted that he displayed remorse and did not violate any bail conditions. And Californian sentencing guidelines are generally very lenient for young offenders. Turner's chance of re-offending is low. Is 6 months lenient? Yeah, but it wasn't surprisingly so. The public defenders' office that worked with Persky stated that he was a fair-minded jurist who probably would've given a similar sentence even if he wasn't a rich, white Stanford athlete.

Yes, the victim wrote an eloquent impact statement, but it's generally not appropriate to consider impact statements in criminal sentencing, because that would amplify racial/class biases. Should a defendant receive a more severe sentence in a case where the victim is an upper-middle-class, highly-educated person with a gift for speechwriting and a strong mental health support network, as opposed to a case involving a less privileged, less-educated victim who finds it more difficult to convey her thoughts into words?

If Persky's detractors wanted a stiffer sentence, the appropriate avenue to do so would be through the legislative process. Subjecting the judiciary to the winds of popular opinion tends to reward cruel and punish merciful judges -- which generally leads to disproportionately harsh sentencing for poor and/or minority defendants.

A combination of inverted totalitarianism and still ironically enough mob rule seems to be where the US is heading.

An unbiased view that informs sentencing procedures is seen as being bigoted and not taking into account historical prejudice against now protected groups.

This might one day fall by the wayside when AI and artificial intelligence start playing a heavier role in determining sentences for criminals. My guess is that such a thing is still one to two decades away at least.

Death penalty for rape is unjust. But the punishment should be more severe for the rape of a virgin.

It should be either sexual anarchy where incels rape freely (as long as it is straight sex) and hedonistically with no care for these things, or it should be pro marital "rape", anti divorce cucking, pro female virginity before marriage, anti extramarital sex system, either way muh foid victims and think about muh foids is a stupid argument and age of the foid doesn't really matter.
