Larson also has state charges in Fresno County, California and Denver County, Colorado to contend with, but it seems that the fedcels at the U.S. Attorney's Office for the Eastern District of California are moving at a pretty fast pace. The grand jury indictment was filed last Thursday and is attached here:



Counts 1-3 (kidnapping, transportation of minor with sexual intent, online coercion and enticement) each carry a maximum sentence of life. Counts 4 and 5 (sexual exploitation of a minor, receipt and distribution of child pornography) carries a maximum sentence of 30 years and 20 years respectively.

Counts 1-4 pertain to the kidnapping attempt of a 12-year-old foidlet (previous incels.co thread here) (Washington Post story here) he met on his website, the subject of many angry CuckTears posts.

If you want more details, here's an excerpt from the affidavit filed by U.S. Department of Homeland Security Special Agent Dada Cheam. It's a copy of the conversation that Larson ("Leucosticte") had with the 12-year-old ("ewwieme").

Count 5 is unrelated to the kidnapping attempt and pertains to material found, pursuant to a search warrant, on Larson's Samsung tablet. The affidavit describes one video as depicting the anal rape of a 7- or 8-year-old female child by a white male adult.

Actually, it doesn't matter what the phone is or where the IP is. It would still have been a crime.

The reason for pointing out where the phone and tablet were manufactured, as well as the IP address of his website, reflects a quirk in the structure of American government: federalism. The vast majority of crimes in the U.S. are handled at the state and local level. Not the federal level.

See, many federal criminal laws expressly limit their application to acts that fall under federal subject matter jurisdiction -- which comes into play on federal property (i.e. a federal government building, federal prison, federal courthouse, national park, Washington D.C., an airport, a U.S. military base, et cetera), and on acts that occurred in or affected "interstate or foreign commerce" (per the Commerce Clause of Article 1, Section 8 of the Constitution).

Therefore, federal prosecutors have to establish that a crime falls under federal subject matter jurisdiction. Fortunately for them, since the 19th century, the federal courts have had an extremely wide interpretation of the phrase "interstate or foreign commerce". If a crime crosses state lines, the feds have jurisdiction over it. If a crime involves immigration, the feds have jurisdiction over it. If a crime involves the internet, the feds have jurisdiction over it.

In this case, by simply establishing that Nathan Larson's electronic devices were manufactured in China by a South Korean company, and that the IP address was traced to a European server, the crime is deemed to have occurred in or affected "interstate or foreign commerce", and the federal government has jurisdiction in this particular case.

Note that just because the federal government has jurisdiction does not necessarily mean that state governments do not, and vice versa -- this is known as concurrent jurisdiction. Larson is facing charges by the federal AND state authorities.

Yes. That's also what the "dual sovereignty doctrine" is. Punishing a person multiple times, to face (one or more) state and/or federal charges, for the same crime, is not a violation of the Double Jeopardy Clause of the 5th Amendment -- see Supreme Court cases United States v. Lanza (1922) or Heath v. Alabama (1985).

In practice, this is relatively rare and only applied if prosecutors in multiple offices really, really, want to throw the book at someone. For example, after the Oklahoma City bombing perpetrators were sentenced to death by the federal government, state prosecutors in Oklahoma (which has the death penalty) also filed charges against them. This was done so that in case the federal death penalty was overturned on appeal, the state death penalty would still stand.

Not in this case, the Judicial Conference of the U.S. has a longstanding rule against recording equipment in federal courtrooms. It might be possible to listen in, though, audio only.

The Fresno County trial, though, that's possible. California allows live cameras in court if the judge consents.

How do they expect us to trust the decision making of courts if we can't even record them? I bet because the cucked judges don't want to be exposed showing favoritism for rosties and government workers. There should be people recording court rooms everyday to keep them honest. If the trial is in fresno california I can go visit him in person and see the trial.

The delay is intended to prevent immediate media coverage and public opinion from unduly influencing the participants of a trial.

That probably depends on each individual court, I'm mainly familiar with the federal system.
