I was just citing a general truth/common sense. I'm not sure about the specifics. You might be correct, but I disagree with "a tall person can't beat a shorter person ONLY if they have muscles and training" because by definition, a taller person with an average BMI would weigh more than a shorter person (an advantage in fighting) and have more reach (also an advantage).

Ok, I agree with you here. According to the law (at least where I live), the taller person would be the instigator (essentially the person who attacked first, even if there was prior verbal provocation).
I guess I used the layman's definition of an "instigator" which is closer to "anyone who provokes someone else in any way whatsoever," which is different than what the law actually says.
