He wasn't and never was her teacher. He was a 6th grade teacher and she just graduated, he would've only been 20 and still in college when she was in the 6th grade. He just was unfortunately a teacher in the same school district she was in.
While Men get arrested for sleeping with 18 year olds and get 20 years, Women are sleeping with 10 year olds and getting little to no jail time.

But if you are 28 and a teacher of THAT 16 year old, then no you can't. But 18 and 28 should be no problem legally in this context, even if I understand the moral controversy in the context of dependency.

Yes, you have to wait 90 days after they graduated. The Nebraska criminal statute defines a "student" for these purposes as someone "at least 16 but not more than 19 years of age," so college wouldn't count unless they were 19 or less I think. Here's the whole statute:
