Stumbled upon this story while reading about cinema on Wikipedia. Complete story is told in this article :


Muybridge married the 21-year-old Flora Stone in 1872. They had a baby boy, Floredo Helios Muybridge, two years later. But Muybridge thought Floredo might not have been his son. He discovered a series of letters between his wife and drama critic Major Harry Larkyns, according to Stanford Magazine. She even sent a picture of Floredo to Larkyns with the caption “Little Harry.”


Muybridge decided to take matters into his own hands. He shot Larkyns through the heart. When Muybridge was put on trial in 1875, he pleaded insanity, but then changed his defense to “justifiable homicide,” or killing without bad intent.

This argument most likely wouldn’t have held up in US court today, but murder laws were much more subjective in the 19th century California. Thus, the jury let him go.

Agreed. A fair châtiment would have been to abandon the wife and her bastard. Especially in 19th century, as I imagine she would have likely turn to prostitution. I don't know what eventually happened though, I didn't look that much into the story.

An other interesting take on the case :

Muybridge made no attempt to escape and the policeman who arrested him noted that he was “very cool for one who had just killed a man”. Even when he was remanded in custody, the press reported him to be “very calm and collected, and apparently feeling entirely justifiable in the killing of Larkyns”. His remarkable self-confidence was well-founded. Within four months a local jury decided unanimously that he was not guilty. Reporters said the courtroom “shook with applause” at the verdict. Muybridge’s murder of his wife’s lover was, the jury said, wholly in accordance “with the law of human nature” and they decided “they could not conscientiously punish him for doing what they would have done themselves

I'm not surprised by his calm behavior after the killing. He acted according to his conscience and felt utterly satisfied once he did. I've never killed anyone, but I know what it's like to finally do something you felt deeply compelled to do.
