Incapacitation is legally rape (although I think there are still a few states where that's not as clearly defined in the statute). In most states, that means if a person is unconscious. In Commiefornia, they have changed the law so it doesn't have to be unconscious, but the accuser still has to be completely out of it, not merely in drunk slut mode.
