I've read of more than one legal case where things were considered fraud for far less circumstances than this.
That being said, you have to take psychology into effect. People get extremely embarrassed after getting tricked and tend to not go to the police. And unless it's upwards of like 3000 dollars, the police truly don't gaf.
So try not to beat the same mark to death for too long to stay off the radar.
