Sexual harassment is the use of someone’s sexual status: their desirability, their sexual history, or their sexual "market value" for humiliation. When you use "incel" as an insult, you are intentionally weaponizing a person’s sexual failure to create a hostile environment.
By labeling a man an "incel," the aggressor is asserting sexual dominance. They are saying: "I am sexually desirable, and you are sexually obsolete." This shames the incel based on their sexual viability. If a manager were to make similar comments about a subordinate’s sexual attractiveness or success, it would be grounds for sexual harassment.
If females were mocked for being "unfuckable" or "forever alone," it would be considered as a cruel, sex-based attack on her dignity. If sexual desirability is a protected aspect of a person’s dignity, then mocking a man’s lack of it is, by definition, sexual harassment.
Another intent behind the word "incel" is to emasculate. It is a form of sexualized bullying. In any other situation, using sexual failures to psychologically torment someone is recognized as a predatory act. Using it as a "gotcha" does not change the predatory nature of the act, it only proves the aggressor’s malice.
The "it’s just a joke" defense is the standard fallback for the harasser. Belittling a man for being an incel is designed to hurt, to isolate, and to remind the man of their involuntary sexual worthlessness.
