A video of a woman engaging in sexual activity without her consent is illegal, an audio recording of everything that took place prior to that event, including her expressing words of consent and/or enthusiasm are not illegal.

Even if the BS you were saying here is true, it would not be admissible in court, but you could still leak it to members of the jury and create a mistrial.

Either way what you are saying sounds like complete nonsense. Recording is not inherently illegal, its a video recording of a sexual act without someones consent that is illegal, and I'm not talking about filming you guys having sex.

Any lawyer could easily make the case for allowing those recordings in because they are related to various aspects of the scenario

1. Establishing a time line

2. Establishing motive

3. Establishing means

4. Establishing possible witnesses (the recording could possibly contradict the accounts of anyone who goes on the record as a witness of her false version of the events)

5. Etc

Like come on dude, what are you even talking about, the only way her lawyer could argue for a recording to not be admissible, is if it was her recording and I stole her phone or something, in other words I illegally obtained the evidence from her, but if its my phone and my recording there's no way for them to argue against it because they can't establish the motive of my recording.

I could argue I was recording a song playing at the bar to look up later because I thought it sounded good, and left the recording up

I could argue a whole lot of things, in fact I'd leave it to my lawyer to argue those things, but you can't just say a recording that is an essential piece of evidence, that was not maliciously created and/or attained, is barred from being evidence, that is complete BS.
