I don't think creators can be held liable for that, actually, if it was uploaded without their permission and they don't get any kickbacks for it.

So you could for example say "hey foid, I am going to make this film of you making a BJ, but I will only share it on DVD sales, it is not authorized for internet distribution" but if some customer then rips the DVD and puts it on the web, it shouldn't be your fault.
