The latest theory to come out of the bright minds over at Reddit Law School is that "rape apology" is...a crime. I mean, truly amazing. I mean, what is "rape apology" anyway?

From what I tell, @zionpill and @erenyeager merely asked how the concept of femoids' rights came to be. That isn't a crime. Even if they expressed the viewpoint that it should be legal to rape femoids, or even that femoids deserve to be raped, that still wouldn't come close to being a crime. Speech doesn't lose protection on the grounds of offensiveness alone.

Rape apology is protected speech. Just as Redditors have the legal right to joke about prison rape, it's perfectly legal for me or anyone else here to tell a femoid that she shouldn't have the right to abort her rapist's fetus or that she was at fault for being raped for dressing like a whore. In fact, these examples of "rape apology" constitute fairly mainstream opinions in many parts of the world, from Afghanistan to Alabama. What happened to the left's supposed tolerance of different cultures?

In the United States, incitement can be constitutionally proscribed only and only if it is intended to and likely to imminent lawless action. See Brandenburg v. Ohio, 395 U.S. 444 (1969). But see, the courts construe the mens rea and the likeliness and the imminence prongs very narrowly.

If you're encouraging someone to break the law at some indefinite future time, that doesn't satisfy the imminence requirement. If you're downplaying the actions of someone breaking the law, that doesn't satisfy the likeliness requirement. If you're advocating, in a philosophical sense, that breaking the law is morally just, that fails both. In Brandenburg, for example, the Court held per curiam that a KKK leader had a First Amendment right to call for "revengeance" against Jews and niggers.

If you're suggesting that the law should be changed (i.e. to legalize rape or severely decrease criminal penalties for rape), that simply isn't incitement at all; that's political speech and receives extra protection. All that aside, there's also the challenge of proving, beyond a reasonable doubt, that you intended to cause rape to happen as opposed to merely being edgy.

Feminists tried to ban pornography in the 1980s by claiming that pornography wasn't protected free speech.
