If he was being aggressive like the girl then he would have been 100% charged with rape. But girl gets the walk free.

If we're gonna go this "I was drunk and therefore not responsible for my actions" route, then just re-criminalize alcohol. The whole reason alcohol is legal is because people agreed "Hey, we're adults, we know alcohol is risky, but as adults we will be responsible and any mistakes we make are on us." You cannot be like "I was drunk, so my 'yes' didn't count." Otherwise my vehicular manslaughter didn't count either.
